Welcome to TheAthlete360. This document outlines our Legal Introduction, Privacy Policy, Terms of Service, and Liability Waiver. Our commitment is to provide a high-performance training environment that prioritizes the safety, privacy, and conduct of every young athlete in our program.

. TERMS & CONDITIONS

Our Services

TheAthlete360 provides athletic-development programs designed to complement sport-specific training. Programs may include strength and conditioning, speed and agility, movement training, mobility, conditioning, recovery, and other performance-development activities.

Our programs are designed to support athletic development and are not medical treatment, physical therapy, or medical advice.

Program content, schedules, locations, coaches, pricing, and availability may change from time to time.

Registration

Participants or their parent/legal guardian must provide accurate and current information when registering.

For participants under 18, registration and participation must be authorized by a parent or legal guardian.

TheAthlete360 reserves the right to refuse or discontinue participation when reasonably necessary for safety, conduct, scheduling, or other legitimate business reasons.

2. PAYMENTS, CANCELLATIONS & REFUNDS

Program fees must be paid according to the pricing and payment terms provided at registration.

Unless otherwise stated:

  • Sessions must be cancelled or rescheduled at least [24 hours] in advance.

  • Late cancellations and missed sessions may be considered used sessions and may not be eligible for a refund or make-up.

  • Refunds for packages, memberships, or programs are subject to the specific refund policy provided at registration.

  • If TheAthlete360 cancels a session, we may provide a rescheduled session, credit, or refund as appropriate.

  • Weather, facility closures, emergencies, or circumstances outside our reasonable control may require schedule changes.

Specific program policies may supersede these general terms when provided in writing at registration.

3. PARTICIPATION & SAFETY

Athletic training involves physical activity and carries inherent risks. These risks may include, but are not limited to, muscle soreness, strains, sprains, falls, collisions, dehydration, heat-related illness, and other injuries.

Participants are expected to:

  • Follow coach and trainer instructions.

  • Use equipment appropriately.

  • Wear appropriate athletic clothing and footwear.

  • Inform the coach of pain, injury, illness, or unusual symptoms.

  • Respect coaches, staff, facilities, and other participants.

  • Follow all applicable facility rules.

TheAthlete360 may modify or stop an activity when a coach believes it is necessary for participant safety.

4. HEALTH INFORMATION & MEDICAL CLEARANCE

Parents/guardians are responsible for informing TheAthlete360 of relevant injuries, medical conditions, physical limitations, medications, allergies, or other circumstances that may affect participation.

Participants should consult an appropriate healthcare professional before beginning an exercise or athletic-development program when appropriate.

TheAthlete360 trainers are not acting as physicians or healthcare providers and do not diagnose, treat, or prescribe medical conditions.

If an injury or medical emergency occurs during a session, TheAthlete360 may take reasonable steps to obtain emergency assistance and contact the emergency contact provided during registration.

5. PARTICIPANT WAIVER & RELEASE

By registering for or participating in a TheAthlete360 program, the participant and, where applicable, the participant's parent or legal guardian acknowledge that physical activity and athletic training involve inherent risks.

To the extent permitted by applicable law, the participant and parent/legal guardian acknowledge and agree to:

  • Assume the inherent risks associated with participation.

  • Follow all safety instructions provided by TheAthlete360 coaches and staff.

  • Accept responsibility for providing accurate health and emergency-contact information.

  • Release and hold harmless TheAthlete360 and its owners, coaches, trainers, employees, and authorized representatives from claims arising from participation to the extent permitted by applicable law.

Important: This waiver should be reviewed and customized by a Texas attorney and your insurance provider before you use it as your official liability release. The final waiver should also address how it applies to minors and signatures by parents/legal guardians.

6. PARENT/GUARDIAN CONSENT

For participants under 18, a parent or legal guardian must complete the required registration and consent forms.

By providing consent, the parent/legal guardian confirms that:

  • They are authorized to provide consent for the participant.

  • The information provided is accurate.

  • They have reviewed the applicable participation and safety policies.

  • They understand the physical nature and inherent risks of athletic training.

  • They authorize the participant to participate in the selected program subject to the applicable waiver and policies.

7. PHOTOGRAPHY & VIDEO

TheAthlete360 may photograph or record training sessions, events, or activities for operational, educational, promotional, or marketing purposes.

Where required, we will obtain appropriate consent before using an identifiable participant's image, name, or video for promotional purposes.

Parents/guardians may contact us regarding questions or withdrawal of future promotional media consent.

8. PRIVACY POLICY

We respect your privacy and are committed to protecting the information provided to us.

Information We May Collect

Depending on how you use our website and services, we may collect:

  • Parent/guardian name

  • Athlete name

  • Athlete age or date of birth

  • Email address

  • Phone number

  • Emergency contact information

  • Training preferences

  • Registration information

  • Information voluntarily provided through forms

  • Payment or transaction information

  • Website usage and technical information

We recommend that parents provide only information that is reasonably necessary for registration and participation.

How We Use Information

We may use information to:

  • Register participants.

  • Provide training services.

  • Communicate about sessions and schedules.

  • Process payments.

  • Respond to questions.

  • Manage programs and facilities.

  • Improve our website and services.

  • Maintain safety and emergency-contact information.

  • Send marketing communications where permitted and where you have opted in when required.

9. CHILDREN'S PRIVACY

TheAthlete360 provides programs for young athletes. We take children's privacy seriously.

Parents or legal guardians should complete registration and provide consent for minors.

We do not intentionally collect more personal information from children than is reasonably necessary to provide our services.

If our online services collect personal information from children under 13 in circumstances covered by the Children's Online Privacy Protection Act (COPPA), we will follow applicable COPPA requirements, including applicable parental-consent, notice, access, deletion, and data-retention requirements.

Parents or guardians may contact us with questions about information collected from their child.

10. INFORMATION SHARING

We do not sell personal information to third parties.

We may share information when reasonably necessary to operate our business, including with:

  • Scheduling or registration platforms

Payments may be processed through third-party payment providers. TheAthlete360 may not directly store complete payment-card information.

You may not reproduce, distribute, modify, sell, or commercially use our materials without written permission.

Our website may contain links to third-party websites or services.

TheAthlete360 is not responsible for the content, security, privacy practices, or policies of third-party websites.

17. CHANGES TO THESE POLICIES

We may update these Terms, Privacy Policy, or other policies from time to time.

Updated policies will be posted on this website with a revised effective date. Continued use of our website or services after an update may constitute acceptance of the revised terms to the extent permitted by law.
